he or she who connects to the Snowexchange.com site seeking information (hereinafter
referred to as the user) to improve the quality of their ski or snowboard travel
experience. SX intends to provide helpful information about travelling and skiing,
only to assist the user in their personal pursuit of a safe and responsible holiday,
with the user taking full responsibilty for their actions during travel. Adventure
travel, high altitudes, skiing and snowboarding involve risks about which the
user must make himself or herself aware. By using the SX service, the user does
hereby agree that neither the user nor his or her heirs, personal or legal representatives,
or family members will bring claims or make a claim for illness, injury or death
resulting from the negligence (but not the reckless, willful, or fraudulent conduct)
of SX, its employees, officers, directors, parnets, managers, agents, contractors
or affiliated organizations or the supplier of any element obtained through the
SX service.
SX acts only in the capacity of an information service for users on matters pertaining
to lodging, activities, and transportation whether by air, rail, bus, automobile
or otherwise and as such SX and its agents shall not be liable for any injury,
damage, loss, accident, delay, or irregularity which may be occasioned whether
by reason of any supplier or otherwise in connection therewith. A contract in
use by the airlines and/or any other transportation supplier, accomodation, rental
supplier, ski provider hereunder shall constitute the sole contract between the
respective company and the customer and/or purchaser of the service. If a customer
is removed or a service cancelled, these matters must be addressed in accordance
with these Terms and Conditions set out by that individual supplier. SX does
not guarantee any specific transport schedule, chalet condition, weather condition,
or any other element related to the information provided in the SX service.
